A federal judge in Pennsylvania has made a significant ruling regarding a lawsuit against billionaire Elon Musk and his political action committee (PAC) over their $1 million daily giveaway to registered voters. The judge has decided to return the case to state court, potentially allowing Philadelphia District Attorney Larry Krasner to take swift action in blocking Musk and his America PAC from continuing the prize distribution in Pennsylvania.
The lawsuit accuses Musk and the PAC of operating an illegal lottery and attempting to influence voters in the presidential election between Donald Trump and Kamala Harris. Additionally, they are accused of violating state consumer protection laws. U.S. District Judge Gerald Pappert dismissed arguments by Musk’s lawyers that the case should be handled in federal court due to its reference to the upcoming presidential election.
Krasner’s office has welcomed the ruling, stating that the efforts by America PAC and Musk to shift the case to federal court were against the law. The attorney representing Krasner’s office, John Summers, mentioned that they are anticipating the state court’s scheduling of the hearing to address the emergency request to stop the $1 million lottery.
Musk had announced that the PAC would conduct a $1 million daily giveaway to registered voters in swing states, including Pennsylvania, until Election Day. The first three prize winners were from Pennsylvania. After being sued by Krasner in state court, Musk’s legal team removed the lawsuit to federal court, leading to the disruption of the hearing in the Court of Common Pleas.
Despite Musk’s lawyer filing a motion to quash the order for Musk’s personal appearance in the hearing, the judge has made it clear that the case could not proceed in the state court at that moment due to the removal to federal court.
